Welcome to vidajets.com (the “Site”). These Website Terms of Use (“Terms”) govern your access to and use of the Site. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms apply to the Site only. Charter flights are governed by a separate written agreement, as explained below.
1. Who We Are
The Site is operated by Vida Jets, LLC (“Vida Jets,” “we,” “us,” or “our”), 3300 Airport Rd, Suite 300, Boca Raton, FL 33431.
Vida Jets is an air charter broker. We are not a direct air carrier. In keeping with the U.S. Department of Transportation’s rules for air charter brokers (14 CFR Part 295), please note:
- Vida Jets does not own or operate aircraft and does not exercise operational control over any flight.
- All flights are operated by FAA-certificated direct air carriers operating under 14 CFR Part 135, or by foreign air carriers holding the appropriate DOT and home-country authority. The operating carrier exercises full operational control of the flight at all times.
- Vida Jets acts as agent for its clients in arranging charter flights.
- The operating carrier for your flight will be identified to you before your booking is confirmed.
2. Quotes Are Not Bookings
Any quote, estimate, or price you receive through the Site, by phone, or by email is an estimate only. It is subject to aircraft and operator availability and may change until your trip is confirmed. No flight is booked, and no seat or aircraft is reserved, until you have signed a Charter Agreement with Vida Jets and made payment as set out in that agreement.
3. The Charter Agreement Controls
Every flight we arrange is governed by a written Charter Agreement between you and Vida Jets. Payment, deposits, cancellation, refunds, and liability for your flight are set out in your Charter Agreement, not on the Site. If anything on the Site conflicts with your Charter Agreement, the Charter Agreement prevails.
4. Pricing
Any price we advertise on the Site is the total price, including all applicable taxes and government fees, such as federal excise tax and segment fees, consistent with the U.S. Department of Transportation’s full-fare advertising rule. Advertised prices remain subject to availability and to the terms of your Charter Agreement.
5. Site Content
We work to keep the Site accurate and current, but its content is provided for general information. In particular:
- Photographs, aircraft images, and descriptions are representative examples. The aircraft assigned to your trip may differ in type, age, configuration, or appearance.
- Empty-leg flights, availability, and pricing change frequently and may be withdrawn or revised without notice.
Nothing on the Site is an offer to provide air transportation.
6. Third-Party Services
The Site includes FlyEasy, a third-party quote tool, and may link to other websites and services that we do not control. Your use of FlyEasy and of any third-party site is governed by that provider’s own terms and privacy policy, and we are not responsible for their content or practices. 7. Intellectual Property
The Site and its content, including text, graphics, photographs, logos, and the Vida Jets name and branding, belong to Vida Jets, LLC or its licensors and are protected by intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to view and use the Site for your personal, non-commercial purposes, such as researching or requesting a charter flight. You may not copy, reproduce, republish, distribute, modify, or create derivative works from Site content, or scrape, crawl, or harvest the Site by automated means, without our prior written permission.
8. Acceptable Use
When using the Site, you agree not to:
- submit false, misleading, or another person’s information;
- use the Site for any unlawful, fraudulent, or harmful purpose;
- interfere with the Site’s security or operation, or attempt to gain unauthorized access to any part of it; or
- introduce viruses, malicious code, or excessive automated requests.
We may suspend or restrict access to the Site for anyone who violates these Terms.
9. Disclaimers and Limitation of Liability
This section applies to your use of the Site only. It does not govern any flight. Flights are governed by your Charter Agreement and the operating carrier’s terms.
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Vida Jets disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, and does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Vida Jets and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of, or inability to use, the Site. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising from or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the jurisdiction of those courts.
11. Changes to These Terms and Contact
We may update these Terms from time to time. Changes take effect when posted on this page, and the “Last updated” date above will reflect the latest version. Your continued use of the Site after changes are posted means you accept the revised Terms. Changes to these Terms do not affect any Charter Agreement you have already signed.
